NIMN Disciplinary Tribunal records first case

The National Institute of Marketing of Nigeria (NIMN) Disciplinary Tribunal has recorded its first case since its inauguration on 7 May, 2021. The move is in line with the provisions of NIMN Act and Code of professional marketing practice, and in accordance with the power conferred on the Disciplinary Tribunal to try marketing practitioners for infamous conduct relating to breaches of the provisions.
This was disclosed by Sidney Ogodo, the Registrar, NIMN, in an exclusive interview with MARKETING EDGE. He stated that the case was brought before the Tribunal in June last year, and has not been concluded. However, the offence before the Tribunal was not disclosed based on sub judice.
“There was a case against a member but it is still pending, the Tribunal has not concluded it. This is how it goes – an individual writes a petition to the Investigation Panel who investigates the petition to see if a prima facie case can be established, which is to say if the allegation has substance. If after the investigation the Panel concludes that it has substance, they will now refer it to the Disciplinary Tribunal, who will sit and look at the case. If they agree that there is a need to proceed further, they will then invite the parties involved to bring their necessary evidence. So that is the process where they are for now,” he said.
He explained that the investigation procedure has no time limit until evidence has been fully established, pointing out that they have had their second sitting on the matter since it kicked off last year.
The NIMN Code of Professional Marketing Practice was approved by members of the Institute, according to NIMN Act 25 of 2003, as a catalyst in building a strong and highly professional marketing Institute.
Recall that the Tribunal held its first meeting 11 months after its inauguration to enable them understand the legal perspective on how they will discharge their duty. Both the Disciplinary Tribunal and the Investigating Panel were inaugurated on the same day for the maintenance of discipline.
