The Advertisers Association of Nigeria (ADVAN) has clarified that the recent court ruling involving DigiBay Limited, the operators of Betway Nigeria, has no bearing on its ongoing lawsuit against the Advertising Regulatory Council of Nigeria (ARCON).

In a formal notice to its members, ADVAN addressed concerns and misconceptions sparked by media reports surrounding the Federal High Court’s decision in Suit No: FHC/L/CS/1262/2024, a case brought by DigiBay Limited, Super Group Limited, and Otunba Kunle Olamuyiwa against the Attorney General of the Federation and the Advertising Regulatory Council of Nigeria, ARCON.

The association emphasized that the ruling does not affect or influence its separate legal action against ARCON currently before Justice Allagoa at the Federal High Court, Lagos Judicial Division.

ADVAN firmly stated that it is not a party to the DigiBay case and, therefore, not bound or impacted by the ruling. It further stressed that the subject matter, legal arguments, and reliefs sought in the DigiBay suit are “fundamentally distinct” from those in Suit No. FHC/L/CS/2089/2023, filed by ADVAN against ARCON and six other parties.

The association maintained that its suit remains active and centers on critical constitutional issues, which are yet to be determined by the court. The matter, it confirmed, has been adjourned for hearing.

Reassuring its members, ADVAN stated it will continue to act in their best interests and provide timely updates on the case and related developments in the advertising landscape.
